What Is LMIA?
A Labor Market Impact Assessment document is issued by the Human Resources and Social Development Canada (HRSDC). It is to verify that a Canadian worker could not fill the vacant position; hence it has been assigned to a foreign worker. This is required to be presented to Canadian employers who wish to hire a foreign worker on a temporary basis.
The Process
The entire process for LMIA may take up to three to four months. Once a foreign worker is able to secure a positive LMIA, they are eligible to apply for a work permit. A work permit allows international workers to work in Canada legally.
However, a positive LMIA restricts the worker for specific factors, such as:
- No job changes
- They cannot change their location
- They cannot change their employer
If there is a change in any of these conditions, the individual needs to apply for a new LMIA.
